While Illinois law mandates that claims against an estate must be filed within two years of death, the court found that a crucial factual issue regarding King Von’s legal residence at the time of his passing had not been addressed.

The key question now is whether King Von was domiciled in Illinois or Georgia. The appellate court noted that the majority of his estate, primarily consisting of music rights and royalties, would be governed by the laws of his actual residence. If it is determined that he was living in Georgia, the two-year filing deadline would only apply to a small portion of his estate located in Illinois. This ruling paves the way for a hearing in probate court to clarify his domicile status.
